Terms & Conditions

These Terms & Conditions are issued by Emergency Medical Services Pty Ltd atf EMSAS Trust (ABN 23 791 570 058), Registered NDIS Provider 4050012974, trading as Emergency Medical Services (“EMS”, “we”, “our”, “us”). By purchasing or using our products or services you agree to the following Terms & Conditions.
⚠ Safety and Limitations
- EMS medical alert devices are aids only. They are not a substitute for emergency services or medical care, and cannot guarantee prevention of injury, loss or death.
- Operation depends on mobile network and GPS coverage. Outages or interference can occur beyond our control.
- Users are responsible for keeping devices charged, maintaining SIM credit (if applicable) and ensuring programmed contacts are aware of their responsibilities.
This disclosure is provided up front to set clear expectations and forms part of our Terms & Conditions.
- Website content & medical advice
We endeavour to keep website information accurate but make no guarantees. Content is for general guidance only and is not medical advice. Always consult a medical professional before acting on any information or claims.
- Products and services
EMS supplies medical alert devices and related services to assist users in daily life. Devices are not intended to replace medical equipment or emergency services, cure or prevent medical conditions, or guarantee prevention of injury, loss or death.
- Network coverage
Devices use the Telstra mobile network or another carrier selected for coverage. Network outages or future changes beyond our control may affect service. GPS and 4G functionality are limited by network coverage and signal availability. EMS does not guarantee continuous operation.
- Limited liability
To the maximum extent permitted by law, EMS is not liable for injury, death, damage or loss arising from use or failure of a device. If liability arises despite this clause, it is limited to the purchase price of the device. This limitation does not exclude guarantees under the Australian Consumer Law (ACL).
- Refund and returns
You have 14 days from receiving your device to return it for a refund less a $90 administration fee (covering programming, packaging and shipping).
Email care@emsas.com.au within 14 days to initiate a return.
Goods showing wear, damage, alteration or not in original packaging are not eligible.
Postage/insurance costs are borne by the buyer. EMS is not responsible for parcels lost or damaged in transit.
Coverage issues: test the system within 14 days. If coverage is inadequate and no alternate SIM/network can be provided, return the device for a refund.
Cancellation before dispatch: full refund less transaction/credit-card fees.

Our Warranty & Fair Use Policy (available at [link]) forms part of these Terms & Conditions.
- Governing law
Despite the domicile or residence of any of the parties to the Contract, the parties covenant that the Contract shall be governed by and construed in all respects in accordance with the law of the State of Queensland and submit to the non-exclusive jurisdiction of the Courts of the State of Queensland with respect to any legal proceedings relating to the Contract.
- Entire agreement
These Terms & Conditions, together with the Privacy Policy, Warranty & Fair Use Policy and returns policy available at www.emsas.com.au, constitute the entire agreement between you and EMS and may only be amended in writing.
